Bid4Time Terms and Conditions

By using the Bid4Time Website you hereby agree to all of the terms and conditions that are listed below. If you do not accept these terms and conditions you may not use or receive services from this website. Bid4Time may amend these Terms & Conditions at any time by posting the amended conditions on our site. Any amended conditions shall automatically become effective.

GENERAL TERMS

By using the Bid4Time Website you confirm that you are of legal age, we do not allow minors to register on this site. Bid4Time may refuse services to anyone that does not qualify. We may add, change or delete any of the services at any time.

As the seller/rentor you are the legal owner of the goods and services you are offering for sale/rent on this Site and you have the legal capacity to conclude the sale and to pass the title in the goods and services to the successful buyer/rentee. You must be legally able to sell/rent the property or properties you advertise for sale or rent on Bid4Time.

As the buyer/rentee you have the legal capacity to purchase any goods or services that you bid for, and, will not otherwise be breaching any law in purchasing those goods or services, you will not bid for any goods or services on this Site unless you are able, and have sufficient, available capacity to pay for those goods or services. The purchase of any goods and/or services on this Site is absolutely at your own risk, all bids are final and not retractable by the buyer/rentee.

This site acts as a venue for sellers/rentors to conduct auctions and for bidders to bid on sellers/rentors auctions. We are not involved in the actual transaction between buyers/rentees and sellers/rentors. As a result, we have no control over the quality, safety, legality or accuracy of the items listed, the ability of sellers/rentors to sell items or the ability of buyers/rentees to buy items. We cannot and do not control whether or not sellers/rentors will complete the sale of items they offer or buyers/rentees will complete the purchases of items they have bid on.

This site gives users an opportunity to use our software to advertise properties without any guarantee from Bid4Time. The final transaction is conducted solely between sellers/rentors and buyers/rentees.

Sellers/rentors and buyers/rentees agree to hold Bid4Time and its members and employees completely harmless regarding any disputes that may arise, without any exceptions. Sellers/rentors list their properties at their own discretion. It is the responsibility of the sellers/rentors to monitor and manage their own auction. Buyers/rentees bid at their own risk.

Because we are not involved in the actual transaction between buyers/rentees and sellers/rentors, in the event that you have a dispute with one or more users, you release Bid4Time and its members and employees from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

We do not control the information provided by other users which is made available through our system. You may find other user's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using our site. Please note that there are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals.

FEES AND SERVICES

It is FREE to advertise. Bidding is FREE. It is FREE to search the auctions. The Seller/rentor will however have to pay a commission if the bid is successful. All currency is represented in South African Rands unless otherwise specified within the auction. Bid4Time has the right to modify fees at any time and will post the new fee structure on its website. If you currently have an auction running on Bid4Time, it will be under the old fee structure until the auction ends at which time it will be applied to the new fee structure.

COMMISSION
The following commissions shall be payable to Bid4Time by the seller/rentor in respect of all sales concluded by auction on this site, depending on the purchase price.

Commissions are only payable when an auction is successful. An invoice will be sent to the seller/rentor and the seller/rentor has seven days in which to pay Bid4Time their commission. Bid4Time will only accept cash deposits, cheque deposits or internet transfers into the following bank account:

Failure to pay Bid4Time commission will result in legal action being taken and the username being posted on the Internet.

You are responsible for conducting your own investigation regarding any and all claims made by prospective bidders or sellers/rentors. You assume all liability for use of any information you find at Bid4Time. Bid4Time, its members and employees assume no responsibility and in no way warrants the accuracy of the information contained in any of the pages published here.

None of the information contained in any Bid4Time web pages is confirmed or warranted by any party. Confirmation of information published herein is the sole responsibility of the seller/rentor.

PRIVACY
Bid4Time asks that you provide personal information to register or bid on an auction. This information will be kept confidential. Bid4Time does not circulate your information outside of our own company. We do use cookies on our site which are harmless and are used primarily for tracking your usage throughout the site. Bid4Time uses your information to send you emails regarding information pertaining to your listings, auctions, bidding status and any other matter pertaining to your activity on the site.

Bid4Time collects your data in order to validate the information to make this site a safe auctioning environment. You agree to provide up-to-date contact information to be released to another user if you place a winning bid on an auction or receive a winning bid on your auction.

LAWS

This site and all transactions concluded on it are subject to the laws of the Republic of South Africa and you hereby agree to be subject to and bound by such laws. If you are uncertain as to whether or not any act may be in conflict with any laws which may impact upon any transaction or the laws applicable in the Republic of South Africa, it is essential that you clarify this issue and obtain the necessary advice prior to proceeding with such course of action.
